PACKAGE TOUR AGREEMENT BETWEEN THE TRAVEL AGENCY AND THE CONSUMER
I. PARTIES TO THE AGREEMENT
This agreement is made between YESIDO TRAVEL, located at “HACET MAH. ALAİYE CAD. 62/1, ALANYA,” with contact numbers 0532 5907637 and 0534 7363429, email address [email protected], and website www.yesidotravel.com (hereinafter referred to as YESIDO TRAVEL), and the participant whose name, surname, and address are specified in the registration form as part of their participation in a package tour program (hereinafter referred to as the CONSUMER). The agreement shall bind both parties in accordance with the terms and conditions set forth below.
II. SUBJECT OF THE AGREEMENT
Under this agreement, YESIDO TRAVEL agrees to fulfill the obligations outlined in the package tour program, while the CONSUMER agrees to pay the specified fees.
III. GENERAL PROVISIONS
The total price of the package tour, including taxes, the prepayment amount, and the deadline for the remaining payment, along with the start and end dates, departure times, departure locations, accommodation details (including type, location, quality, and class), meal plans, travel routes, transportation information, age and health requirements, and minimum participant numbers (if applicable), are detailed in the tour brochure.
Should changes occur within the outlined standards, YESIDO TRAVEL reserves the right to make adjustments with prior notification to the CONSUMER.
Brochures provided at registration serve as sample programs. Dates and locations of optional tours are subject to change and are not obligatory elements of the package.
The CONSUMER must report any deficiencies in service execution immediately to YESIDO TRAVEL. Failure to notify in writing during the service execution may forfeit the CONSUMER's right to demand a reduction in the tour price.
Tours organized by YESIDO TRAVEL may include accommodations in mountain or plateau houses. By signing the agreement, the CONSUMER acknowledges potential limitations, such as shared facilities, as indicated in the brochure.
Participants listed in the registration but not signing the agreement are deemed to have accepted its terms through the authorized signee.
The CONSUMER is jointly responsible for fulfilling all obligations for additional participants registered under their name.
In the event of issues, the CONSUMER must first seek remedies from the original responsible party before addressing claims to the travel agency under the applicable insurance policy.
IV. INSURANCE COVERAGE
CONSUMERS purchasing package tours from YESIDO TRAVEL are insured under the "Domestic Mandatory Travel Insurance Policy" issued in accordance with the Travel Agencies Law No. 1618.
This insurance covers specific conditions, such as agency insolvency, cancellations due to sudden illness or accidents during the trip, emergency medical expenses, and repatriation within policy limits.
The CONSUMER may request additional insurance coverage by providing written notice to YESIDO TRAVEL and agreeing to pay any additional costs.
V. PRICING, PRICE CHANGES, AND PAYMENT PLAN
The package tour price includes accommodation services for the number of nights specified in the "services included in the price" section of the tour description, breakfast and dinner for each night of accommodation, guidance services, mandatory travel insurance, vehicle and fuel expenses, and national park vehicle expenses. All other services not explicitly mentioned as included will be considered excluded.
In cases where additional services not covered by the package price are requested, the consumer is required to pay the additional costs incurred by these services.
YESIDO TRAVEL reserves the right to make changes to the package price before the conclusion of the contract in the event of significant fluctuations in transportation costs, fuel prices, or other unforeseen external factors. If there is a significant increase in the total price due to these factors after the contract has been concluded, YESIDO TRAVEL must notify the consumer immediately. The consumer then has the right to accept the revised price or cancel their participation in the package tour without incurring any penalties.
Payment schedules and deadlines will be determined and communicated at the time of booking. Consumers are responsible for ensuring timely payment of the agreed amounts to avoid potential cancellation or forfeiture of services.
VI. CANCELLATION, REFUNDS, AND CHANGES
If the consumer wishes to cancel their participation in the tour, the following conditions apply:
Cancellation Period:
For cancellations made more than 30 days before the tour's departure, a full refund of the paid amount, minus a minimal administrative fee, will be provided.
For cancellations made within 29 to 15 days before departure, 50% of the total amount will be refunded.
For cancellations made less than 14 days before departure, no refund will be issued.
Changes to the Itinerary:
YESIDO TRAVEL reserves the right to make changes to the tour itinerary for reasons such as adverse weather conditions, safety concerns, or unforeseen operational difficulties. Consumers will be informed promptly of any such changes.
Force Majeure:
In cases of force majeure (e.g., natural disasters, strikes, pandemics), YESIDO TRAVEL will offer alternative travel dates or a refund based on the specific circumstances.
VII. RESPONSIBILITIES OF YESIDO TRAVEL AND THE CONSUMER
YESIDO TRAVEL's Responsibilities:
YESIDO TRAVEL is responsible for ensuring that all services outlined in the package tour agreement are provided in accordance with the agreed standards.
Consumer's Responsibilities:
The consumer is obligated to provide accurate personal details and documentation required for the trip (e.g., passports, visas).
The consumer must also notify YESIDO TRAVEL immediately of any issues or deficiencies during the trip.
VIII. INSURANCE COVERAGE
Consumers who purchase package tours through YESIDO TRAVEL are covered under the "Domestic Mandatory Travel Insurance Policy" as per Law No. 1618 on Travel Agencies. This insurance policy provides coverage for situations such as the agency's bankruptcy, inability to fulfill commitments, or specific circumstances leading to trip cancellations.
The policy also includes coverage for medical emergencies or accidents occurring during the package tour within Turkish borders. This includes expenses related to medical treatment, emergency transport, or repatriation, subject to the policy's terms and limits.
IX. FINAL PROVISIONS
This agreement is governed by the laws of the Republic of Turkey. Any disputes arising from this contract will be resolved in accordance with Turkish law. By signing this agreement, the consumer confirms that they have read and understood the terms outlined above.
In cases where the agreement is signed by a representative on behalf of a group, the representative assumes joint responsibility for all members listed in the booking.
This contract is valid once signed by both parties and remains in effect for the duration of the services specified.
